Is it possible to upgrade skills without a legendary item, and how do I get capability points.

In order to upgrade skills without an unique item you need a blue item that matches the skill your general has, for example the refined imperial broadsword can be equipped by Eatius since it improves counter infantry expert.
You get distributable capability points from upgrading your general's rank(liutenent, brigade commander, etc) not to be mistaken with title(duke, emperor, etc).
